Terms of Use

BulBul.af is run by Pixels Clinic (“BulBul.af”, “we”, “us”). We provide an online classifieds marketplace through bulbul.af and the BulBul.af mobile applications (together, the “Service”).

By browsing, registering, posting, or otherwise using the Service, you agree to these Terms. If you don’t agree with any part of them, please don’t use the Service. We may update these Terms from time to time; the version on this page is always the current one. If we make a meaningful change we’ll flag it on the site.

These Terms are written in English. We may publish translations in Dari and Pashto for convenience, but in case of any inconsistency, the English version governs.

BulBul.af is a marketplace platform. We connect buyers and sellers — we don’t buy, sell, ship, or take payment for the items listed. Any transaction happens directly between you and the other user. We don’t hold money, escrow funds, or get involved in disputes about quality, delivery, or refunds.

You’re responsible for the listings, messages, images, and any other content you post. By posting content on BulBul.af, you confirm that:

• The content is yours, or you have the right to share it.
• It doesn’t infringe anyone’s copyright, trademark, or privacy.
• It complies with the laws of Afghanistan.

You grant BulBul.af a worldwide, royalty-free licence to display, store, distribute, and modify your content for the purpose of operating and promoting the Service. We may apply a watermark to uploaded images to discourage scraping. This licence ends when you (or we) remove the content from the platform.

We don’t pre-approve every listing, but we reserve the right to remove anything that breaks these Terms, the law, or our content guidelines — with or without notice. We’re not responsible for content posted by other users.

BulBul.af may offer paid promotions like Featured and Urgent placements that increase the visibility of your listing. Payment for these promotions is handled by a third-party gateway. We make no warranty about the security or availability of those gateways and we’re not liable for any losses caused by them.

Promotion fees are non-refundable once the promotion is active, even if the underlying listing is removed for violating these Terms.

You agree not to use BulBul.af to post, upload, or share anything that:

• Breaks Afghan law or any applicable regulation.
• Infringes someone else’s copyright, trademark, or other rights.
• Is harmful, abusive, threatening, defamatory, obscene, or hateful — including content that targets people based on religion, ethnicity, gender, age, or disability.
• Reveals another person’s personal details without their consent.
• Impersonates anyone or misrepresents your affiliation with a business or organisation.
• Is false, deceptive, or constitutes a bait-and-switch offer.
• Promotes pyramid schemes, chain letters, spam, or unsolicited commercial messages.
• Advertises items or services that are illegal under Afghan law — including but not limited to weapons, illicit drugs, counterfeit goods, or anything that endangers minors.
• Contains viruses or malicious code.
• Floods the platform with duplicate content or otherwise interferes with normal service.

You also agree not to:

• Contact users who’ve asked not to be contacted, or harass anyone.
• Scrape, crawl, or harvest data from BulBul.af with automated tools (other than well-behaved search engines that respect our robots.txt).
• Post the same listing across multiple categories or provinces to game visibility.
• Try to access systems or data you’re not authorised to access.
• Use bots or scripts to file reports, post content, or otherwise operate the platform on your behalf.

We may suspend or terminate your account if you break any of these rules, and we may remove content that doesn’t comply.

Some categories or promotions may require a fee. Each posting is your responsibility and must follow these Terms. Paid postings are non-refundable if the listing is removed for a violation, and credits can’t be transferred to another user or another listing.

A “posting agent” is any third party that posts content on behalf of someone else. Unless you’ve received written permission from BulBul.af, you may not post on behalf of others, and you may not authorise someone else to post on your behalf.

We grant you a limited, revocable, non-exclusive licence to access and use BulBul.af for personal, non-commercial purposes. You may link to individual listings from a personal blog, news article, or social post — but you can’t republish, scrape, or redistribute large portions of the site without written permission.

General-purpose search engines (Google, Bing, etc.) may crawl the site to the extent allowed by our robots.txt. Other automated access — including any service that specialises in classifieds or aggregates listings — requires our prior written consent.

If you believe content on BulBul.af infringes your intellectual property rights, send us a notice at legal@bulbul.af including:

• Your name, contact details, and a signature (physical or electronic).
• The work or right you say has been infringed.
• A link to the specific BulBul.af listing(s) you believe are infringing.
• A statement, made in good faith, that the use isn’t authorised by the right-holder, their agent, or the law.
• A statement that the information you’ve given is accurate and that you’re authorised to act on the right-holder’s behalf.

We review notices promptly and may remove content while we investigate.

All BulBul.af materials — text, design, code, graphics, logos, the BulBul name and mark — are owned by or licensed to Pixels Clinic and are protected by Afghan and international intellectual property laws. You may not copy, reverse-engineer, or redistribute any of it without our written permission. Listings remain owned by the users who post them, but they grant us the licence described in Section 2.

You understand that content on BulBul.af comes from many sources, and we can’t guarantee its accuracy, safety, or legality. You use the Service at your own risk and agree that we’re not responsible for content posted by other users.

You agree to indemnify and hold BulBul.af, Pixels Clinic, and our team harmless from any claims, damages, or costs arising from your use of the Service, your breach of these Terms, or your violation of someone else’s rights.

Sending unsolicited commercial messages through BulBul.af — by chat, email, or any other channel — is prohibited. We may monitor message content with automated tools to detect spam and scams, and we may suspend accounts that violate this policy.

Any deal you make on BulBul.af is between you and the other user. We’re not responsible for the delivery, quality, or condition of items, and we don’t mediate disputes. If something goes wrong, work it out with the other party — and if a real crime happened, please report it to the appropriate Afghan authorities.

We may set limits on how the Service is used — including how many listings you can post, how long content is stored, and how often you can access the site. We may also suspend or terminate your access at any time if you violate these Terms, and we may modify or shut down parts of the Service without notice. We’re not liable for any loss caused by such changes.

The Service is provided “as is”, without warranties of any kind, express or implied. We don’t guarantee that the site will be available, error-free, or secure, and we make no representations about the accuracy or completeness of any content. To the maximum extent allowed by Afghan law, we disclaim all warranties.

BulBul.af, Pixels Clinic, and our team are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service — including damage caused by other users, third-party links, or any interruption of the site. Our maximum liability to you for any claim relating to the Service is the amount you’ve paid us in the 12 months before the claim.

You can’t transfer or assign your account or any rights under these Terms without our consent. We may assign these Terms freely, for example as part of a sale or restructuring of the business.

BulBul.af is intended for adults. You must be at least 18 years old to register and post listings. If you’re under 18, you may only use the site under the supervision of a parent or legal guardian. Children under 13 must not use the Service at all.

These Terms are governed by the laws of the Islamic Republic of Afghanistan. Any dispute will be handled by the competent courts in Kabul, Afghanistan. If a court finds any part of these Terms invalid, the rest remain in effect. Our failure to enforce a provision isn’t a waiver — we can still enforce it later.

If you spot a listing or user breaking these Terms, please report it through the “Report” button on the listing, or contact us at help@bulbul.af. We read every report and act on the ones that genuinely violate the rules.
